Digital Omnibus on the Data Act – a necessary measure
The EU’s Digital Omnibus is an important step in creating a more unified and legally certain framework for data sharing, Confederation of Swedish Enterprise concludes in a position paper.
The Confederation of Swedish Enterprise proposes additions and amendments regarding the omnibus to:
Clarify and improve certain definitions
Strengthening the protection of trade secrets
Limit B2G data sharing to real public emergencies
Ensure full cost recovery in case of mandatory data sharing
Make requirements for cloud switching proportionate and legally certain
Reduce administrative burdens on data transfers
The Omnibus is a step in the right direction, but more is needed. It is therefore very welcome that the European Commission has launched a Digital Fitness Check, to review the entire EU digital rulebook and assess whether today’s digital legislation is still coherent, effective, and competitive in a rapidly changing technological environment.
